These Terms & Conditions ("Terms") govern your use of The Internet Monument (the "Service"), operated by Made4Music ("we", "us", "our"). By claiming a place on the monument, you agree to these Terms.
The Internet Monument offers a limited, permanent digital monument consisting of one million places. By claiming a place, you may add a first name, a country, an optional city, and an optional short message, which are displayed publicly on the monument. Each place is assigned a unique monument number and a fixed set of coordinates upon approval.
The price for one place is shown at checkout and is charged in euros (EUR). Payment is processed securely by Mollie. Your place is only confirmed once payment has been successfully received and your submission has been approved (see section 4).
The monument is designed to be permanent and unchangeable. Once your place is approved:
When all one million places are claimed, the monument closes permanently and no further places can be added.
All submissions are subject to approval. We may refuse or remove any submission, before it becomes a permanent place, that we consider unlawful, offensive, infringing, misleading, or otherwise inappropriate — including names or messages containing hate speech, obscenity, advertising, or another person's personal data. If your submission is rejected for such reasons, we may, at our discretion, refund your payment. You agree not to submit:
Under EU consumer law you normally have a 14-day right to withdraw from a distance purchase. However, this right does not apply to digital content and services that are delivered immediately with your prior express consent. Because your place is created and delivered immediately upon approval, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once delivery begins. Accordingly, all sales are final and payments are non-refundable, except where we choose to refund a rejected submission under section 4, or where a refund is required by law.
You confirm that any content you submit is yours to submit, does not infringe anyone's rights, and does not contain another person's personal data without their consent. You are responsible for what you choose to make permanently public. You must be legally able to enter into this agreement and to make the payment.
By submitting content, you grant us a perpetual, worldwide, royalty-free licence to store and display that content as part of the monument, for as long as the monument exists. This licence reflects the permanent nature of the Service.
Approved places may include a downloadable certificate showing the public details of the place (name, location, monument number, coordinates and date). Certificates are provided as a keepsake and have no monetary or legal value.
We aim to keep the Service available but do not guarantee uninterrupted access. We may update, suspend, or modify parts of the Service for maintenance, security, or improvement. We may update these Terms from time to time; the "last updated" date reflects the current version, and continued use constitutes acceptance.
To the fullest extent permitted by law, our total liability arising from your use of the Service is limited to the amount you paid for your place. We are not liable for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your mandatory consumer rights.
These Terms are governed by the laws of the Netherlands. Disputes will be subject to the competent courts of the Netherlands, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
